By using the services provided by GLXHost you expressly agree that you will abide by the terms and conditions as set out below. These terms and conditions may be updated at any time. It is thereby recommended that you check the current terms and conditions on a regular basis. GLXHost will not be held responsible for any resultant problems or failures to provide the services that are derived from your failure to follow these terms and conditions. Your continued use of the services of GLXHost implies your continued acceptance of the then current terms and conditions. 
 
Content

You may not store more data in your account than your allotted server space.
Your server space and ftp account is for your personal use only. You must not divulge the password to any other person and you should take reasonable precautions to ensure that it is not discovered. If, at any time, you believe that a breach of security may have taken place you must immediately inform GLXHost. This will assist GLXHost to take measures to endeavour to keep your data secure.  
The following list is content unacceptable to Wanting website for web-hosting services. It is not, however, an exhaustive list of material that may be deemed as unacceptable content. Please note that links to such sites or the advertising of such sites is unacceptable.
 
Content that: Infringes Third Party Intellectual Property or Proprietary rights, Rights of publicity or privacy; Violates any law, statute, ordinance or regulation under UK Law.
Defamatory, Libellous, Threatening, Harassment; Abusive, Erotic, Pornographic or Obscene;
Content that contains Viruses, Trojan Horses, Worms, Time-bombs, Cancel Bots, Corrupted files or any other similar software and/or programs that may damage the operation of another's computer or the property of another.
Contain Pirated or Hacking/ Phreaking Software (Warez)
Software that is copyrighted and not freely available for distribution without cost. ROMs, ROM Emulators and Mpeg Layer 3 files (MP3) all fall under this jurisdiction;
 
Server Abuse / Rules
 
You may not run server processes (e.g. talkers/IRC Bots) from your web space. 
We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services. When your account is closed, all files (including web pages, files etc.) will be deleted. We reserve the right to cancel your account at any time without notice.
 
Availability
 
Notwithstanding our advertised 99.9% uptime; to ensure our high quality of service to our customers we do, from time-to-time, upgrade and modify our servers; this may at times cause downtime. We will not be held responsible for any unforeseen events that cause downtime.
 
Backups

GLXHost have weekly backups of data on our servers, however it is recommended that you keep an independent backup of all data stored on your web space. GLXHost is not responsible for loss of data. If you need a backup that we have restored then you may incur a charge of £20 minimum.
 
Data Protection
 
To protect your privacy we never distribute your name or e-mail address to any third parties. 
Users must not participate in any form of un-solicited bulk e-mailing or spam. By logging into
your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions. Details of your account, held by us, are held under the guidelines and rules of the Data Protection Act 1998. For further information on this matter please see our Privacy Policy.
 
Domain Registrations
 
When a domain is registered you details are visible to the public. This is known as WHOIS information.  By default we show this information. We are not a domain registrar; however we do provide domain registrations via eNom.
 
When its time to renew your domain you will receive an e-mail reminding you that payment is due.
Due to the automated renewal system for domain names we need to know as soon as possible if you wish to renew your domain name or not. Late notification regarding renewal or otherwise may incur an administration charge of £20.
PLEASE NOTE Late notification of renewal may lead to the loss of your domain name!
 
Bandwidth
 
GLXHost operates a policy where in each hosting package you, as a client, have limited bandwidth. Exceeding the specified bandwidth may lead to, without prior notice, the disabling of your site. If your site is disabled due to exceeding the bandwidth limit any shared and reseller accounts will automatically show an account suspension page. 
 
Web Pages
 
Commercial use of web and ftp space is permitted. Adult websites are not permitted to be hosted on our servers (See ‘Content’ section above). You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
 
You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
 
We reserve the right to remove material deemed inappropriate from your web pages, without prior notice.
 
Cancellation and Refunds
 
We do not offer refunds for domains. Once a domain order has been processed that domain is registered to you for the period of time that you chose the registration to last. Refunds for Monthly Hosting are offered depending on circumstances of the request. We reserve the right not to refund clients.
 
Yearly Hosting

You can get a refund from our Yearly packages; however this must be done within the first 14 days from your order being placed. (Excludes Domain Refund) Refunds may have a transaction fee which will come from your payment.
 
We reserve the right not to issue refund if the client has signed up for fraud purposes.
 
GLXHost reserves the right to cancel the service at any time. Customer refund will not occur if our service shuts down. We will then no longer host or renew your domain or host your website.
 
VPS & Dedicated Servers
 
Once a VPS or dedicated order has been placed and payment has been made we will undergo construction of your server. Due to this we are unable to offer refunds once server construction has started. Refunds can only be offered for hardware failure or configuration problems. Please take note of the above when considering your request.
 
Illegal Content
 
If your account has any illegal content we will contact you and request its removal. If, after 24 hours, you do not cooperate we will suspend your account. We reserve the right to suspend / cancel your servers at any time.
 
Billing
 
When you are billed for your hosting, you will receive reminders letting you know payment is due. Payment must be made before the date on the invoice. If payment has not been made three days after this date your account shall be suspended. If payment is still not received by 10 days after the renewal date, your account will be removed from the server with the resultant loss of data.
 
Renewal notices are sent up to 10 days before the renewal date.
 
Fraud Sign-Ups
 
We do not tolerate fraud signups at GLXHost. Any orders considered to fit this category will be queried. If the client subsequently requests a refund, any charges incurred by GLXHost will be deducted from any refund that may be due. Notwithstanding the foregoing GLXHost reserve the right to refuse refunds to fraud signups and may consider taking legal action against such signups.
 
Hosting
 
We reserve the right to change our hosting packages at anytime, regarding to price and/or resources.
 
Indemnification
 
Customer agrees that it shall defend, indemnify, save and hold GLXHost harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitor’s fees asserted against GLXHost, its agents, sub-contractors, its customers, officers and employees that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.
 
Customer agrees to defend, indemnify and hold harmless GLXHost against liabilities arising out of:-
 Any injury to a person(s) or property caused by any product sold or otherwise distributed in connection with GLXHost server; Any material supplied by a customer that infringes or allegedly infringes on the proprietary rights of a Third Party; Copyright Infringement and/or Intellectual Property rights; Any defective products sold to customer from GLXHost server.
 
If any customer is rude or disrespectful to staff or users of GLXHost we reserve the right to cancel services at any time without refund. All have the right to work or go about their own business free of abuse or harassment; please respect this right.
 
Disclaimer
 
GLXHost will not be responsible for any damages your business may suffer, GLXHost makes no warranties of any kind, expressed or implied for services we provide. GLXHost disclaims any warrantee, merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by GLXHost and its employees.
